A car accident in New Port Richey usually happens at a signal. US-19 at Main Street, US-19 at Trouble Creek Road, SR-54 at Madison Street, Rowan Road at Trouble Creek. Someone runs the light, misjudges a left turn across three lanes, or looks up from a phone too late. Then the practical questions start: which agency wrote the report, and which insurance company is going to pay.
Conde-Huggins Accident Injury Lawyers answers those questions for New Port Richey drivers and passengers from our office at 6609 Ridge Road in Port Richey, a short drive north on US-19. The consultation is free, there is no attorney's fee unless we win, and we will come to Morton Plant North Bay or to your home. Call (240) 421-5511 at any hour.
Where car accidents happen in New Port Richey
US-19 between Main Street and Marine Parkway. This is the busiest stretch of the busiest road in west Pasco. Six lanes, back-to-back signals, and plaza driveways on both sides. The crashes we see here are rear-end collisions at the lights, left turns from the median across oncoming traffic, and sideswipes from drivers changing lanes to reach a turn pocket.
SR-54 from US-19 to Little Road. The signals at Grand Boulevard, Madison Street and Rowan Road each carry traffic from a different part of the city onto a six-lane state highway. SR-54 at Madison Street was one of three Pasco intersections singled out in a 2024 law-firm study that ranked the county's intersections ninth deadliest in the nation. In November 2024, FHP investigated a fatal crash at SR-54 and Grand Boulevard involving a propane tanker turning north.
Trouble Creek Road. Residents along the stretch near Spike Horn Drive and Whitetail Lane have asked Pasco County for a traffic signal, and the county told a Tampa Bay 28 reporter in July 2024 that the intersection ranked near the bottom of its 2023 to 2027 funding list and could not be reconsidered before fiscal year 2028. In July 2026, a motorcyclist died there after an SUV crossed through the median opening from Whitetail Lane.
Rowan Road. County Road 77 runs north from SR-54 through the east side of the city, crossing Trouble Creek Road, Massachusetts Avenue and Ridge Road before it becomes Regency Park Boulevard. It is posted at 45 miles per hour, lined with apartment complexes and a senior community, and residents have described it to reporters as a road where cars are "flying."
Massachusetts Avenue and the downtown grid. Massachusetts Avenue, Grand Boulevard, Main Street and Madison Street are slower, but drivers there are turning, parking and watching for pedestrians all at once. A single-vehicle crash on Massachusetts Avenue at Van Buren Street, investigated by New Port Richey police, left the driver critically injured at HCA Florida Bayonet Point.

Why the agency that responded matters
New Port Richey is one of the few places in Pasco County with its own police department. Inside the city limits, the New Port Richey Police Department investigates crashes and its Records Section at 6739 Adams Street releases reports in person on weekdays or through the city's JustFOIA portal. On US-19 and SR-54, especially when someone is seriously hurt, the Florida Highway Patrol often takes the investigation instead. Just outside the city, in Elfers and the unincorporated pockets along Rowan Road and Trouble Creek Road, the Pasco Sheriff's Office may respond.
The difference shows up in the report. A trooper or a city officer typically writes a long-form report with a diagram, a narrative and witness names. A deputy may file a short form that lists the drivers and nothing else. When the report is thin, we build what it left out. For how to request a report from each agency, see our Pasco crash report guide.
The Florida rules that decide a New Port Richey car accident claim
Four rules do most of the work.
PIP and the 14-day window. Your own personal injury protection pays 80 percent of medical bills and 60 percent of lost income up to $10,000, no matter who caused the crash, as long as you got initial care within 14 days (Fla. Stat. § 627.736). A physician, physician assistant or nurse practitioner has to document an emergency medical condition, or the medical benefit is limited to $2,500. Morton Plant North Bay's emergency department is on Madison Street, and a visit there within two weeks of the crash satisfies the rule.
The permanent-injury threshold. To collect pain and suffering from the at-fault driver, Fla. Stat. § 627.737(2) requires a permanent injury within a reasonable degree of medical probability, significant permanent scarring, significant permanent loss of a bodily function, or death. The finding has to appear in your treating doctor's records. We make sure the question gets asked.
Two years to file. Fla. Stat. § 95.11(5)(a) gives you two years from the crash date to file a negligence suit for any crash on or after March 24, 2023. Older crashes keep the prior four-year period.
The 51 percent bar. Under Fla. Stat. § 768.81(6), a driver found more than 50 percent at fault recovers nothing, and everyone below that line has damages reduced by their share. In a left-turn crash on US-19, the insurer for the turning driver will say you were speeding through a yellow. Signal timing records, business video and the physical evidence answer that, which is why we gather them before the adjuster calls you.
Call (240) 421-5511 before you give any insurer a recorded statement.
Who pays after a New Port Richey crash
Florida requires drivers to carry PIP and property damage liability, not bodily injury liability. The driver who hit you on Trouble Creek Road may have no coverage at all for your injuries. The coverage that fills that gap is uninsured/underinsured motorist coverage under Fla. Stat. § 627.727, on your own policy or on a policy belonging to a relative in your household. Here is why UM coverage matters so much in Pasco.
We also look at the employer of a driver who was working, the owner of the vehicle under Florida's dangerous instrumentality doctrine, a rideshare policy if the other driver was logged in to Uber or Lyft (Fla. Stat. § 627.748), and the city or county if a municipal vehicle or a GOPasco bus was involved. Government claims carry the notice requirement and damage caps of Fla. Stat. § 768.28, with a separate clock.

Questions people ask us about new car accident cases
My crash was on US-19 at Main Street. Who has the report?
Main Street at US-19 is inside the New Port Richey city limits, so the New Port Richey Police Department most likely investigated and its Records Section at 6739 Adams Street holds the report. If a trooper responded instead, which happens on serious US-19 crashes, the Florida Highway Patrol has it. The exchange slip you received at the scene names the agency and the report number. If you do not have it, call (240) 421-5511 and we will track the report down for you.
My crash was at SR-54 and Madison Street. Is that New Port Richey or Elfers?
That intersection sits at the southern edge of the city, and crashes there are often worked by FHP Troop C or the Pasco Sheriff's Office rather than city police. It does not change the law that applies or where a lawsuit would be filed. Pasco County civil cases from the west side go to the West Pasco Judicial Center on Little Road, and the same two-year deadline under Fla. Stat. § 95.11(5)(a) applies whichever agency wrote the report.
I went to Morton Plant North Bay the night of the crash. Have I met the 14-day rule?
Yes. An emergency room visit within 14 days of the crash satisfies the initial-treatment requirement in Fla. Stat. § 627.736, so your PIP medical benefits are preserved. The next question is whether a physician, physician assistant or nurse practitioner documented an emergency medical condition, because without that finding PIP medical benefits stop at $2,500 instead of $10,000. We read the ER records to confirm it and follow up with the hospital if the chart is silent.
Residents have asked Pasco County for a light at Trouble Creek Road and Spike Horn Drive for years. Can the county be sued for not installing one?
Rarely. Decisions about whether and when to add a signal are usually treated as planning-level judgments that Florida's sovereign immunity statute protects. Fla. Stat. § 768.28 also caps any recovery against the county at $200,000 per person and requires written notice before suit. In nearly every crash on that stretch, the claim that pays is the one against the driver who failed to yield, backed by your own uninsured motorist coverage if that driver carried no bodily injury insurance.
If my New Port Richey case goes to court, where is it heard?
At the West Pasco Judicial Center, 7530 Little Road in New Port Richey, which handles civil cases for the west side of Pasco County in Florida's Sixth Judicial Circuit. Most car accident claims resolve with the insurer before a lawsuit is filed, but we prepare every case as if it will be tried there. Our attorney has appeared in that building for decades, and insurers factor that in when they decide what a claim is worth.
