Hit at a US-19 signal in Hudson?

Hudson car accident lawyer

Hudson's crashes happen at the signals on US-19 between SR-52 and the county line, and the people in them are older than almost anywhere else in Pasco. Both facts shape the claim. Conde-Huggins is a few miles south on Ridge Road and meets Hudson clients at Bayonet Point or at home.

The crash happened at a light. US-19 at Hudson Avenue, US-19 at SR-52, US-19 at Beacon Woods Drive. Someone did not stop for a red, or turned left across the northbound lanes with a car already in them, and now you are home from HCA Florida Bayonet Point with discharge papers and a sore neck that is getting worse instead of better.

Conde-Huggins Accident Injury Lawyers is at 6609 Ridge Road in Port Richey, a few miles south of Hudson on US-19. We are the closest injury law office to Hudson, and we meet clients in their rooms at Bayonet Point or at their kitchen tables in Beacon Woods, Heritage Pines and the neighborhoods along Hudson Avenue. The consultation is free. Call (240) 421-5511.

Hudson's crash spots, signal by signal

Hudson has no downtown grid. It has US-19, the signals along it, and the roads that feed them. Traveling south from the Hernando line:

County Line Road. The boundary with Hernando County, and the road that connects US-19 to the Suncoast Parkway at exit 37. Heritage Pines, a 55-and-over golf community, sits a mile east of US-19 on it, and its residents enter and leave through that one intersection.

Little Road at US-19. Little Road (CR-1) branches off US-19 in north Hudson and runs south along the east side of the community to SR-52 and beyond. The junction with US-19 mixes highway traffic with drivers starting or ending a trip down the four-lane county road.

Denton Avenue and New York Avenue. Both run east from US-19 into the residential areas toward the Highlands. New York Avenue is where FDOT's US-19 lighting retrofit ends, and in September 2025 FHP investigated a fatal crash at its signal in which a car turning left onto US-19 entered the path of oncoming traffic.

Hudson Avenue. The main east-west street, running west to the marinas on the Gulf canals and east to Beacon Woods and Fairway Oaks. FHP has investigated a fatal rear-end chain-reaction crash at a signal on US-19 just south of Hudson Avenue, where a driver failed to stop for traffic waiting at the red.

Clark Street and Beacon Woods Drive. Clark Street leads west to Hudson Beach and Robert J. Strickland Memorial Park; Beacon Woods Drive leads east to the Beacon Woods golf community. Both are side-street approaches to a six-lane highway with heavy turning traffic in season.

SR-52 at US-19. The southern edge of Hudson, where State Road 52 begins its run east to the Suncoast Parkway and Dade City. The largest intersection on the corridor, and the one hospital-bound traffic uses. Our Bayonet Point car accident page covers it in detail.

Why age changes a Hudson car accident claim

Hudson's median age is 57 and nearly four in ten residents are 65 or older, according to 2020 Census figures for the Hudson CDP. The Pasco MPO counted 2,624 crashes involving older drivers countywide in 2022, with 23 deaths. For an injury claim, age cuts in several directions at once.

Injuries are more serious. The same rear-end impact that leaves a 30-year-old with a strained neck can fracture an older driver's sternum, vertebrae or hip. Recovery is slower, surgery is riskier, and a fall during recovery is common.

The insurer blames the injury on age. Degenerative changes on an MRI become the insurer's explanation for your pain. Florida law holds a negligent driver responsible for aggravating a condition that was already there, but the medical records have to draw the line between before and after. We ask your doctors to do that in writing.

Lost income is not the measure of the loss. PIP's disability benefit replaces 60 percent of lost gross income, which is nothing for a retiree. What a retired Hudson resident loses is the ability to drive, to garden, to care for a spouse, to live without help. Those losses are compensable as pain and suffering and loss of enjoyment of life once the threshold in Fla. Stat. § 627.737(2) is met.

Medicare has a claim. When Medicare pays for crash treatment at Bayonet Point, federal law requires it to be repaid from the settlement. We handle that reimbursement so it does not surprise you at the end.

Seasonal residents complicate the paperwork, not the claim. A snowbird hurt on US-19 in February and treated in Michigan in May still has a Pasco County claim. We coordinate the out-of-state records.

Call (240) 421-5511 and we will tell you how these factors apply to you.

The Florida rules that decide a Hudson claim

Fourteen days. Fla. Stat. § 627.736 pays PIP medical benefits only if initial care came within 14 days of the crash. The Bayonet Point ER satisfies it. If you drove home and are reading this a week later, see a physician this week; a chiropractor cannot make the emergency medical condition finding that unlocks the full $10,000 instead of $2,500. More on the 14-day rule here.

Two years. Under Fla. Stat. § 95.11(5)(a), a negligence suit must be filed within two years of the crash for crashes on or after March 24, 2023. A wrongful death claim has the same limit under § 95.11(5)(e).

The 51 percent bar. Fla. Stat. § 768.81(6) bars recovery for anyone more than 50 percent at fault and reduces it by the percentage below that. Side-street crashes on US-19 are the classic dispute: the driver pulling out from Denton Avenue says the highway driver was speeding; the highway driver says the other car pulled out into a closed gap. The physical evidence decides it, and we collect it first. How comparative fault works in Florida.

UM/UIM. Florida requires no bodily injury liability coverage on most private cars. Many Hudson drivers, saving money on fixed incomes, carry the $10,000 PIP and $10,000 property damage minimum. If the driver who hit you is one of them, your own uninsured/underinsured motorist coverage under Fla. Stat. § 627.727 is what pays for a serious injury. Bring your declarations page to the first meeting.

FHP, the Sheriff and the report

Hudson is unincorporated. There is no Hudson police department, so crashes are worked by FHP Troop C, which handles most Pasco crash investigations, or by the Pasco Sheriff's Office. The ambulance is Pasco County Fire Rescue. The report is sold through the Florida Crash Portal, restricted for 60 days to the parties, their attorneys and insurers under Fla. Stat. § 316.066(2), and can take up to ten days to appear. We order it for every client, and when the Sheriff's Office wrote a short form, we build the rest of the record ourselves. Our guide to Pasco crash reports explains each agency's process.

Questions people ask us about hudson car accident cases

I am 74 and had a bad back before the crash on US-19. Will the insurer say my injuries were already there?

Yes, and the law does not let them off that easily. A driver who injures someone takes that person as they find them: aggravating a pre-existing condition is a compensable injury, and under Fla. Stat. § 627.737(2) an aggravation that is permanent can meet the threshold for pain and suffering. The key is medical documentation that compares your condition before and after the crash, which is why we obtain your prior records and ask your treating physicians the question directly.

Medicare paid my hospital bills at Bayonet Point. Does that affect my settlement?

It does. Under the federal Medicare Secondary Payer law, Medicare has a right to be repaid from an injury settlement for the crash-related care it covered, and the settlement cannot be finalized properly without resolving that claim. The same is true of a Medicare Advantage plan. We report the claim to Medicare, obtain its conditional payment figure, dispute charges that were not crash-related, and resolve the reimbursement from the settlement so you are not left with the bill afterward.

My crash was on County Line Road. Is that a Pasco case or a Hernando case?

County Line Road is the boundary, and a crash there may be investigated by FHP regardless of which side it occurred on. Where a lawsuit is filed is governed by Fla. Stat. § 47.011, which allows suit in the county where the crash happened or where the defendant lives. For a Hudson resident hit by a Spring Hill driver, that can mean a choice between Pasco and Hernando. The two-year deadline, the PIP rules and the 51 percent bar are the same in both.

We are only in Hudson for the winter. Can you handle the case after we go back north?

Yes. Most of a car accident claim is handled by phone, email and mail after the initial investigation, and we regularly represent seasonal residents whose treatment continues with doctors in another state. The important steps happen while you are here: the crash report, the scene evidence, the Bayonet Point records and the first treatment within 14 days. If the case is filed, it is heard in Pasco County, and we handle the appearances. Call (240) 421-5511 before you leave town.

How is a Hudson crash report different if a deputy wrote it instead of a trooper?

The Pasco Sheriff's Office generally does not complete long-form crash reports. If a deputy responded to your crash on Hudson Avenue or in Beacon Woods, the report may be a short form with the drivers' names and insurance and nothing else. A trooper's long form includes a diagram, narrative and witness list. When the report is thin, we build the record ourselves from photographs, 911 audio, witness statements and video, and we do it in the first days before that evidence is gone.
