Wesley Chapel's fatal crashes happen at speed. I-75 between the SR-56 and SR-52 interchanges, the two-lane section of SR-54 east of Curley Road, and the left turns on Bruce B. Downs Boulevard account for most of them. The Pasco Metropolitan Planning Organization has counted roughly 103 traffic deaths a year across the county from 2018 through 2022, a fatality rate about 30 percent above the Florida average, and names I-75 among the corridors where those deaths cluster.

If your family has lost someone on one of those roads, Conde-Huggins Accident Injury Lawyers will take the legal work off your hands. We meet Wesley Chapel families at home, on your schedule, and there is no attorney's fee unless we recover compensation. Call (240) 421-5511 when you are ready.

What happens in the weeks after a fatal Wesley Chapel crash

Most families have never seen this process, so here is what to expect.

The FHP traffic homicide investigation. Fatal crashes on I-75, SR-54, SR-56 and Bruce B. Downs are worked by the Florida Highway Patrol, Troop C, whose traffic homicide investigators reconstruct the crash over weeks or months. Their file is far deeper than an ordinary crash report: scene mapping, vehicle downloads, witness interviews and, when impairment is suspected, toxicology. If the other driver is charged, the State Attorney's prosecution runs on its own track. Your family's civil claim does not wait for it.

The medical examiner. Pasco County deaths are handled by the District Six Medical Examiner's Office, which serves Pasco and Pinellas counties. Its findings on cause of death become part of the civil case.

The insurers. The at-fault driver's insurer may call within days, sympathetic and ready with an offer. A wrongful death release signed early ends every survivor's claim, including claims for losses no one has calculated yet. Let us take that call. Dial (240) 421-5511 and we will handle the insurers from that point on.

The estate. The claim belongs to the estate's personal representative, so an estate has to be opened in Pasco County. We coordinate that filing so probate and the investigation move together.

Who the law recognizes as a survivor

The Florida Wrongful Death Act, Fla. Stat. §§ 768.16–768.26, defines survivors in § 768.18(1): the spouse, the children, the parents, and any blood relatives or adoptive brothers and sisters who were partly or wholly dependent on the decedent for support or services. The Act's definition of "minor children" is its own: children under 25 years of age.

Section 768.21 then assigns damages by category. A surviving spouse recovers lost support and services, loss of companionship and protection, and mental pain and suffering. Minor children, and all children when there is no spouse, recover lost parental companionship, instruction and guidance, and mental pain and suffering. Parents of a deceased minor child recover mental pain and suffering; parents of an adult child do so only if there are no other survivors. The estate, through the personal representative, recovers lost earnings from injury to death, lost net accumulations where the statute allows, and medical and funeral expenses.

Two things the Act does not do: it does not let the survivors recover the decedent's own pain before death, because under § 768.20 the injured person's claim does not survive, and it does not let families file separately. One action, brought by the personal representative, for everyone.

Who in your family fits which category is a question we answer at the first meeting. Call (240) 421-5511.

Where the money comes from after a fatal Wesley Chapel crash

Florida does not require private drivers to carry bodily injury liability coverage, so the driver who caused the crash may have nothing. Every policy has to be found:

  • PIP on the decedent's own auto policy pays a $5,000 death benefit under Fla. Stat. § 627.736(1).
  • Uninsured/underinsured motorist coverage under § 627.727, on the decedent's policy or on a household member's, is frequently the largest source of recovery in a Wesley Chapel death case. Interstate crashes with out-of-state drivers make it more important, not less.
  • Commercial and trucking policies. A tractor-trailer on I-75 carries federally required coverage far above any private policy. See our Wesley Chapel truck accident page.
  • Rideshare coverage of at least $1 million applies while an Uber or Lyft driver is on a ride (Fla. Stat. § 627.748(7)).
  • Umbrella policies, which families often forget they have.

Comparative fault still applies. Under Fla. Stat. § 768.81(6), if the person who died is found more than 50 percent at fault, the survivors recover nothing from the other driver, and a smaller share reduces the recovery. Insurers argue fault hardest when the one person who could answer is gone. The reconstruction evidence is how we answer for them.

Bar liability is narrow. Fla. Stat. § 768.125 allows a claim against a bar only for willfully serving someone underage or knowingly serving a person habitually addicted to alcohol. Most impaired-driving deaths are pursued against the driver and the family's UM coverage.

Deadlines that do not move

A wrongful death suit must be filed within two years of the date of death under Fla. Stat. § 95.11(5)(e). If a county vehicle, a GOPasco bus, a school bus or a state road defect was involved, § 768.28(6) requires written notice to the agency within two years, a 90-day wait before suit, and caps recovery at $200,000 per person and $300,000 per incident.

Evidence has its own deadlines. The vehicles get salvaged, plaza and ramp cameras overwrite in days, and witnesses who were passing through on the interstate scatter across the state. We send preservation demands the week we are retained.

What Conde-Huggins does for a Wesley Chapel family

  • Meets you at home, in Wesley Chapel, when you are ready, and explains the process once in plain language.
  • Opens the estate and has a personal representative appointed in Pasco County.
  • Obtains the FHP traffic homicide file, 911 recordings, medical examiner findings and vehicle data, and preserves the vehicles and video.
  • Identifies every survivor under § 768.18 and documents each person's losses under § 768.21, with an economist where lost support and net accumulations require one.
  • Presents the claim to every insurer, and files at the Robert D. Sumner Judicial Center in Dade City when the offers do not reflect the loss.

Clementine Conde, a Florida Bar member since 1992, handles each case personally. For the statute in full detail, see our wrongful death page; for the community, see Wesley Chapel.

Questions people ask us about wesley chapel wrongful death cases

FHP says the traffic homicide investigation will take months. Do we wait for it before doing anything?

No. The FHP investigation runs on its own schedule and your family's civil claim runs on another. Evidence that the civil case needs, including the other vehicle, plaza and ramp camera footage and witness contact information, can be gone long before the trooper's report is finished. We send preservation demands in the first week and open the estate at the same time. When the homicide report and any toxicology results are released, they become part of the case.

Who in our family is allowed to bring the claim?

The personal representative of the estate, on behalf of all survivors and the estate, under Fla. Stat. § 768.20. Family members do not file separate lawsuits. The personal representative is the person named in the will or, if there is none, the person the probate court appoints, usually the surviving spouse or a person chosen by a majority of the heirs. If no estate has been opened, we help your family open one in Pasco County so the claim can proceed.

My father was killed on I-75 and my brother and I are in our twenties. Can we recover anything?

Under Florida's Wrongful Death Act, 'minor children' means children under 25 (Fla. Stat. § 768.18(2)). A child under 25, and every child if there is no surviving spouse, may recover for lost parental companionship, instruction and guidance and for mental pain and suffering under § 768.21(3). Adult children over 25 may recover lost support and services they were receiving. The estate separately recovers medical and funeral expenses and lost net accumulations where the statute allows.

The crash was on Bruce B. Downs, and the other driver was in a company vehicle. Does that change the claim?

It usually improves it. An employer is responsible for an employee's negligence on the job, the vehicle's owner is liable under Florida's dangerous instrumentality doctrine, and commercial policies carry far higher limits than a private Florida driver, who is not required to carry bodily injury coverage at all. If the vehicle belonged to Pasco County, GOPasco or the school district, Fla. Stat. § 768.28 applies instead: written notice within two years, a 90-day wait, and a cap of $200,000 per person.

How long does a Wesley Chapel family have to file a wrongful death lawsuit?

Two years from the date of death under Fla. Stat. § 95.11(5)(e). Government claims require written notice within the same two years under § 768.28(6). Because a personal representative must be appointed and the investigation completed before suit, the practical deadline is sooner than it sounds. We ask families to call when they are ready, and well before the second anniversary.
